1. General Information

These Terms of Use ("Terms") govern your access to and use of TutorAI ("the Service"), operated by AKSA Corp OÜ. By creating an account or using the Service, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, please do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.

2. Description of the Service

TutorAI is an AI-powered homework assistance platform designed to help students understand academic concepts. The Service allows users to submit questions or upload images of homework problems and receive step-by-step explanations generated by artificial intelligence.

TutorAI is intended as a learning aid — to support understanding, not to replace genuine study effort.

3. Eligibility and Age Requirements

The Service is intended for students in grades 5–12.

• Users under the age of 18 must use the Service under parental or guardian supervision and approval.
• By registering an account, you confirm that you are either 18 years of age or older, or that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• We reserve the right to suspend or terminate accounts where we have reason to believe a minor is using the Service without parental consent.

Parents and guardians are responsible for monitoring their child's use of the Service.

4. Account Registration and Security

To use the Service, you must create an account using a valid email address and password.

You agree to:

• Provide accurate and truthful information during registration.
• Keep your login credentials confidential.
• Notify us immediately at support@gettutor.app if you suspect unauthorised access to your account.
• Not share your account with others.

You are responsible for all activity that occurs under your account. TutorAI is not liable for any loss or damage resulting from unauthorised access to your account caused by your failure to protect your credentials.

5. Acceptable Use

You agree to use the Service only for lawful, educational purposes. You must not:

• Use the Service to submit content that is illegal, abusive, harmful, or offensive.
• Attempt to bypass, disable, or interfere with any security features of the Service.
• Reverse engineer, scrape, or copy the Service or its outputs for commercial use.
• Use automated scripts, bots, or tools to interact with the Service in ways not intended by its design.
• Impersonate another person or entity.
• Upload images or content that you do not have the right to share.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Academic Integrity

TutorAI is designed to help students understand their homework — not to complete it for them.

You agree that:

• You will use the Service as a learning tool, not as a means to submit AI-generated answers as your own work.
• You will not use TutorAI to cheat, deceive teachers, or violate the academic integrity policy of your school or institution.
• TutorAI bears no responsibility for academic misconduct resulting from misuse of the Service.

We strongly encourage students to use the explanations provided by TutorAI as a guide to developing their own understanding and to always submit their own work.

7. AI Disclaimer

TutorAI uses third-party AI technology to generate explanations. Please be aware of the following:

• AI-generated content may contain errors, inaccuracies, or outdated information.
• The explanations are not reviewed or verified by human educators before delivery.
• TutorAI does not guarantee the accuracy, completeness, or appropriateness of any AI-generated content.
• The Service should not be used as a substitute for qualified professional advice in any subject.

Always cross-reference important answers with your textbook, teacher, or other reliable sources.

8. Subscription & Payments

Free plan: All users receive 3 free explanations per day.

Pro plan: For unlimited explanations, users may subscribe to TutorAI Pro at €9.90 per month.

• Payments are processed securely through Stripe, LLC (https://stripe.com).
• Your subscription renews automatically each month on the same date it was activated.
• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access to Pro features until that date.
• Refunds are not issued for partial billing periods.
• TutorAI reserves the right to change subscription pricing. We will notify you at least 30 days in advance of any price change. Continued use of the Pro plan after the change takes effect constitutes acceptance of the new price.
• All prices include applicable taxes where required by Estonian law.

9. Withdrawal Waiver

Consumer residing in the European Union generally have the right to withdraw from a distance contract within 14 days without giving any reason.

However, by subscribing to TutorAI Pro plan, you expressly:

• Request immediate access to the Service before the end of the withdrawal period.
• Acknowledge that the Service is a digital service delivered immediately upon activation.
• Acknowledge that you thereby lose your right of withdrawal once the Service has been fully or partially performed.

Accordingly, subscription fees are non-refundable once the Service has been activated, unless otherwise required by applicable law.

10. Fair Usage Policy

To ensure a reliable and high-quality experience for all users, TutorAI applies a fair usage policy.

Free users:

Pro users:

These measures are not hard limits — you can always submit requests. Delays are applied transparently to protect system availability and keep the Service affordable for everyone.

11. Data & Content Handling

Your submissions: When you submit a question or image, it is processed by our AI provider to generate an explanation. We do not store the full content of your submissions long-term beyond what is necessary for the immediate session and explanation history.

Explanation history: Summaries of your explanations are stored in your account to allow you to review past sessions. You may delete individual entries or your full history at any time from your account dashboard.

Images: Uploaded images are sent to our AI provider for processing and are not retained on our servers after the explanation is generated.

Account data: We store your name (if provided), email address, settings preferences, and usage counts. This data is used solely to operate the Service.

By using the Service, you grant TutorAI permission to process your submitted content solely for the purpose of generating explanations.

12. Intellectual Property

All content, branding, design, and software comprising the TutorAI platform is the property of AKSA Corp OÜ and is protected by intellectual property laws.

• You may not copy, reproduce, distribute, or create derivative works of any part of the Service without our express written permission.
• AI-generated explanations provided through the Service are licensed to you for personal, non-commercial educational use only.
• You retain ownership of any content you submit. By submitting content, you grant us a limited licence to process it for the purpose of providing the Service.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• TutorAI is provided on an "as is" and "as available" basis without warranties of any kind.
• AKSA Corp OÜ is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.
• This includes, but is not limited to, academic consequences, loss of data, or errors in AI-generated content.

Our total liability to you for any claim arising from use of the Service shall not exceed the monthly amount of your subscription.

14. Termination

By you: You may delete your account at any time from the account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

By us: We reserve the right to suspend or permanently terminate your account at any time if you violate these Terms, engage in abusive behaviour, or for any other reason at our sole discretion. In cases of serious violations, termination may occur without warning.

Upon termination, your right to access the Service ceases immediately. Any unused Pro subscription period is non-refundable unless required by applicable law.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia.

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia. If you are a consumer resident in the European Union, you may also have the right to bring proceedings in your country of residence.
